Our Managing Director and Principal, Athena Koelmeyer recently presented a webinar on the amendments to the FW Act commencing on 6 June 2023 and what they mean for employers. This webinar covered:
- the enterprise agreement approval process, including changes to the pre-approval requirements and the Fair Work Commission’s (FWC’s) recently published ‘Statement of Principles on Genuine Agreement’;
- the revised ‘Better off Overall Test’ which now requires the FWC to undertake a ‘global assessment’ of the proposed agreement against a modern award;
- the new streams of multi-enterprise bargaining and the FWC’s power to deal with bargaining disputes;
- changes to industrial action, in particular the Protected Action Ballot period and notice requirements; and
- new requirements for responding to requests for flexible work arrangements and unpaid parental leave, including the FWC’s new power to resolve disputes.
