Webinar Recap: Secure Jobs, Better Pay - 6 June 2023 - Key changes for employers

In December 2022, the Federal Government passed the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Cth) resulting in several significant changes to the Fair Work Act 2009 (Cth). These changes have and will come into effect on various dates, with the latest wave of amendments being live as of 6 June 2023.

In December 2022, the Federal Government passed the Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Cth) resulting in several significant changes to the Fair Work Act 2009 (Cth) (FW Act). These changes have and will come into effect on various dates, with the latest wave of amendments being live as of 6 June 2023.

Our Managing Director and Principal, Athena Koelmeyer recently presented a webinar on the amendments to the FW Act commencing on 6 June 2023 and what they mean for employers. This webinar covered:

  • the enterprise agreement approval process, including changes to the pre-approval requirements and the Fair Work Commission’s (FWC’s) recently published ‘Statement of Principles on Genuine Agreement’;
  • the revised ‘Better off Overall Test’ which now requires the FWC to undertake a ‘global assessment’ of the proposed agreement against a modern award;
  • the new streams of multi-enterprise bargaining and the FWC’s power to deal with bargaining disputes;
  • changes to industrial action, in particular the Protected Action Ballot period and notice requirements; and
  • new requirements for responding to requests for flexible work arrangements and unpaid parental leave, including the FWC’s new power to resolve disputes.

In April 2026, the Full Bench of the Fair Work Commission has issued a final determination varying the rostering provisions with respect to sleepovers in the Social, Community, Home Care and Disability Services Award 2010 to remove ambiguity or uncertainty and to achieve the modern awards objective to provide fair and relevant minimum safety net of terms and conditions.

New regulations dealing with the fixed term contract exceptions

In December 2023, the Fair Work Act 2009 (Cth) was amended to introduce limitations on fixed term contracts, making it unlawful for employers to engage employees on term contracts in the same role beyond two years (including any extensions or renewals) or two consecutive contracts.
