Response to Accidents and Injuries
Unfortunately, even the best prepared employers may still suffer accidents or injuries in their workplace. In this event, Workplace Law assists our clients to manage and mitigate the impact of any investigation by WorkCover and any litigation by injured employees.
The process of managing workplace accidents or injuries should always start with a formal investigation of the circumstances surrounding the event.
Workplace Law is able to conduct ourselves and/or arrange an investigation by an expert Consultant, to provide a complete report of the facts and circumstances of the incident. Factual reports are critical to managing any litigation arising from the incident (including any WorkCover prosecution) and can often be a learning and development guide in preventing further incidents.
Working together with insurers and employers
For some of our employer clients, dealing with their workers’ compensation insurer is an unfamiliar process. At Workplace Law we can provide assistance as your insurer’s “employer preferred” lawyers. Many of our NSW clients are able to request that their insurer appoint Workplace Law as their “employer preferred” lawyers for workers’ compensation matters.
This is particularly useful where the circumstances of the claim might involve employment issues (discipline, termination, performance management) or WHS issues (potential prosecution) as it means that you can have one firm advising and representing your interests. You and your insurer benefit from having a legal advisor who is across all issues (workers compensation, employment, WHS etc) and who can therefore provide you with a single agreed strategy rather than having competing strategies that do not take into account all the issues.
