Shane has been a member of Workplace Law since 2005 and was appointed a Director of the firm in 2011.

Qualifications

  • Diploma of Law (Legal Practitioners Admission Board).
  • 14 years experience.

Relevant Experience

  • Since 1998 Shane has practiced extensively in the workers compensation field acting on behalf of a number of insurers, self insurers, specialized insurers and in his capacity as the preferred solicitor for a number of employers ranging from small business to Local Councils, national and international employers.
  • Shane has extensive experience in the defense of claims for common law damages and statutory entitlements in state courts and commissions.
  • Shane has participated in a number of projects for both insurers and self insurers.  These projects have included advising clients on how to effectively manage long term liabilities by correctly applying the relevant workers compensation legislation.  In New South Wales this is included Section 52A projects, and Section 55 applications to reduce and terminate awards.
  • Shane has also advised employers in the area of employment law particularly in the area of effective termination of injured workers.
  • Shane advises employers on the best way to manage injured employees so as to minimize the financial burden and impact on their workers compensation premium.
  • Shane assists employers with respect to working with their workers compensation insurer to insure all claims are effectively managed and, where appropriate, declined or accepted.
  • Shane works in conjunction with risk management advisors in helping employers deal with occupational health and safety and workers compensation compliance and responsibilities in relation to prevention accidents.
  • Shane is also experienced in advising insurers and employers how to effectively pursue their recovery rights under Section 151Z in New South Wales.
  • Shane has participated in mediation and settlement conference for his major clients as a means of alternative dispute resolution in narrowing the issues in dispute and reducing legal costs.
  • Shane has experience in commercial litigation particularly in recovering moneys owed to major corporate and statutory bodies in the local and district courts.
  • Shane is also experienced in drafting contracts of employment as well as policies and procedures.
  • Shane advises clients in relation to their obligations under the occupational health and safety legislation.
  • Shane assists employers with matters for Fair Work Australia including unfair dismissal matters and general protections disputes.
  • Shane also advises and works with employers in the area of discrimination law including responding to complaints and/or ensuring compliance with relevant discrimination legislation.
